It shall be deemed that you have accepted the following Terms and Conditions of Use. Any changes made to these Terms and Conditions shall be binding upon you without further notice.

1. Agreement

1.1 Omplatform Co., Ltd. (“We,” “Our,” or “Company”) provides services via the omplatform.com website, the application, and other products (“Services” or “Wallet”). Before using any services, please read these Terms and Conditions (“Terms” or “Agreement”) carefully, including any regulations or announcements issued by Omplatform via the application or website. This document also includes all conditions, rules, and recommendations related to the use of the Wallet.

1.2 The application is intended to provide a personal wallet for accessing, storing, and recording data on the blockchain network. The Company cannot access users’ private keys or modify their blockchain records (Non-Custodial).

1.3 The application encrypts the private key using a PIN code entered and stored on the user’s device. Users are solely responsible for recording their private keys.

1.4 The application does not hold or safeguard any tokens or digital assets on behalf of users.

1.5 By using the application under these Terms, you confirm that you have read, fully understood, and agreed to all the conditions herein. The Company grants you permission to use the application under these Terms.

2. Intellectual Property Rights

The application and websites are owned and operated by Omplatform Co., Ltd. All content displayed—including text, images, videos, audio, graphics, or software—is protected by copyright, trademarks, and intellectual property rights. The Company holds or controls all rights to such content.

3. Reservation of Rights and Limitation of Liability

3.1 Content on the application and websites is provided on an “as is” basis. The Company makes no warranties, express or implied, regarding the completeness, accuracy, suitability, timeliness, stability, or reliability of the content or the outcomes resulting from its use, nor the suitability of the application.

3.2 The content does not constitute advice or risk recommendations. Users assume all risks for any actions or decisions made based on the content. The Company and its employees are not liable for any direct or indirect damages, including but not limited to errors, incompleteness, deletions, modifications, defects, viruses, or communication failures.

3.3 The Company is not responsible for damages arising from third parties, including but not limited to unauthorized access (hackers) or cybercrime.

4. Compliance

Users shall not use the application, website, or services for unlawful or unauthorized purposes or upload any content that infringes confidentiality, copyright, trademarks, intellectual property, or ownership rights of others. The Company reserves the right to monitor compliance and enforce appropriate-use policies. Accounts may be suspended or terminated for violations.

5. Privacy Policy

By using the application, you acknowledge and agree that the Company may collect, process, and use your personal data as provided.

Personal Data Definition: Information that identifies an individual directly or indirectly, excluding data of deceased persons.

Collected Data Includes:

• Identification: Full name, address, email, phone number, photos.
• Account info: Username, password.
• Automated/device data: IP address, cookies, usage behavior, service history, voice, images, motion, social media accounts, chat, geolocation.
• Marketing info: Service satisfaction, interests.

Collection Methods:

• Via website forms or subscriptions.
• Through browser cookies or devices.
• Through third-party logins (Facebook, Google, Line, Email & Password).
• Through voluntary surveys, inquiries, or phone/email interactions.
• Through participation in events, seminars, or marketing activities.

Purposes of Use:

• Deliver services, promotions, and marketing tailored to users.
• Analyze and offer benefits aligned with user interests.
• Personalize content and improve user experience.
• Process orders, payments, and deliveries.
• Verify identities, prevent spam or unauthorized actions.
• Comply with legal requirements, and transfer data to affiliates or processors under agreements.

Data Retention:

Data will be stored only as long as necessary for stated purposes or longer if legally required.

User Rights:

• Withdraw consent at any time (without affecting prior lawful processing).
• Request access to or copies of personal data unless restricted by law or court order.
• Request corrections for accuracy and completeness.
• Request deletion, destruction, or anonymization of data when it is no longer needed or consent is withdrawn.

9. User Encryption Responsibility

Users must keep their login credentials confidential. Any actions performed after login are deemed valid and binding on the user. Users are solely responsible for any resulting damages.

10. Breach of Terms

The Company reserves the right to suspend or terminate services for violations of these Terms without waiving its rights to seek remedies under applicable law.

11. Amendments

The Company may amend these Terms or the application at any time, with or without notice. Continued use signifies acceptance of changes. Users should review these Terms regularly.

12. Waiver

Failure or delay to exercise rights shall not constitute a waiver. Partial exercise does not waive other rights.

13. General Provisions

These Terms constitute the entire agreement between the Company and the User and supersede prior agreements. Users may not assign or transfer rights or obligations without written consent. If any provision is found invalid or unenforceable, it shall be replaced with the closest lawful alternative, and the remaining provisions shall remain effective. Non-parties to these Terms shall have no enforcement rights.

These Terms are governed by the laws of Thailand.
